Beverly Kennedy




Beverly has an outstanding track record in major infrastructure projects (PPP and otherwise) and was the key adviser to the Victorian Government on the Environmental Impact Assessment and other approvals for projects such as the Victorian Channel Deepening Project, the Victorian Desalination Project, Northern Victoria Irrigation Renewal Project and more recently the Port of Hastings Development Project.

In addition to her comprehensive experience across all aspects of environment and planning law, she is an expert in public law and provides advice to senior levels of government on governance and other issues affecting major projects, including land acquisition processes. She also has expertise in Native Title.

The industry sectors in which Beverly operates include major projects, government advisory, property development, corporate transactions and energy and resources.

As a former Supreme Court Prize Winner, she has exceptional analytical and problem-solving skills and is a recognised troubleshooter for projects requiring strategic assistance. She is familiar with the multiple interfaces of linear infrastructure and her practice is informed by up-to-date knowledge and creativity in dealing with complex legal issues.

Key deals

CarbonNet Project

Currently advising the CarbonNet team within the Department of Jobs, Precincts and Regions on progressing the CarbonNet Project to enable carbon emissions from future LaTrobe Valley industrial development to be sequestered in the offshore Gippsland Basin. Beverly previously advised the team on the approvals strategy for early investigative works.

Victorian Environment Protection Authority Dual Gas power station proposal

Advised the EPA on the Works Approval for the proposed Dual Gas power station in the LaTrobe Valley, using novel coal gasification technology. Acted for the EPA in subsequent litigation challenging the Works Approval in the context of climate change policy and state carbon reduction targets.

Port of Hastings Development Project

Advised the Port of Hastings Development Authority on the approvals strategy and commissioned environmental studies for the proposed development of a major port in the vicinity of Hastings on Westernport (project suspended following sale of the Port of Melbourne).

Victorian Desalination Project

Acted for the then Department of Sustainability and Environment on the environmental impact assessment, planning scheme amendments and other approvals for the Victorian Desalination Project, including managing the public inquiry into the project’s environmental effects.

Victorian Channel Deepening Project

Successfully conducted the Supplementary Environment Effects Statement for the controversial project to deepen the shipping channels in the Port of Melbourne, following the unsuccessful outcome of the initial EES.

Victorian Department of Treasury and Finance – template PPP contract

Developed the initial template PPP contract embodying the State-preferred risk allocation in the Contractual Issues and Risk Allocation Guide, designed to streamline negotiations and reduce contract costs. This later formed the basis of the National PPP Principles.
