Joseph is a construction and infrastructure specialist in the areas of project delivery, outsourcing and dispute resolution. He advises government and the private sector (including financiers, sponsors, principals and contractors) on all aspects of project and infrastructure delivery across a range of sectors, including education, health, property, energy and resources, transport and water.
He immerses himself in projects during the tender phase in order to understand the technical detail and then supports his clients through project delivery with strategic and practical guidance. His experience through all stages of project procurement gives him keen insight into the issues and risks facing clients during the implementation of large and complex projects, something which he brings to the table early and proves invaluable during tender design and contract negotiation.
His experience spans the full range of contract delivery models, from traditional D&C, EPC, DBOM and PPP models, to relationship-based alliance contracting. He has represented clients in superior courts, arbitration, expert determinations and statutory adjudications.
Acting for the North Eastern Program Alliance participants (Laing O’Rourke, Fulton Hogan, Jacobs Engineering and MTM) in relation to a multi-billion dollar program for removal of numerous level crossings in Melbourne’s northern suburbs, as well as track duplication.
Acting for Australian Paper in relation to all aspects of procuring (together with its partner, Suez) Victoria’s first energy from waste facility, a A$600 million plus 225MW plant in the Latrobe Valley, Victoria.
Acted for South Australia Water Corporation and Crown Solicitors and conducted all aspects of tender and contract negotiations, advised on contract claims through delivery phase and represented in multiple dispute resolution processes (including the Dispute Resolution Board). This project was concluded within budget with all disputes resolved by the commencement of the 20 year operations phase.
Acted for the bidding consortium for this major infrastructure development.
Acted for AED Oil and its joint venture with a subsidiary of Sinopec International Petroleum and Exploration Corporation (China) in relation to offshore oil activities (FPSO) and substantial disputes with the Rubicon Offshore Group.
Acted for Clough Engineering in relation to the A$750 million BassGas project with Origin Energy in Victoria, including ‘stop clock’ arbitration involving in excess of A$250 million in claims.
