Stockland - Elara town centre

Acted on Stockland’s NSW Elara residential and town centre development including voluntary planning agreements, advice on infrastructure provision, planning advice and documentation of access arrangements with adjoining owners for construction of infrastructure and roads.

Queensland Department of Natural Resources Mines & Energy - Strathmore vegetation clearing

Acted in relation to various proceedings concerning the clearing of some 20,000 hectares of vegetation at Strathmore Station in far north Queensland. This included defending two judicial review proceedings relating to decisions on PMAVs, an appeal to the P&E Court against an enforcement notice, and peripheral assistance to a prosecution run in-house by the State (including disclosure of 27,500 documents in a 7 day timeframe). DNRME was successful in the prosecution, the judicial review proceedings were both withdrawn, and the enforcement notice appeal was resolved on the basis of extensive rehabilitation requirements.

Private sector developer - Rhodes

Acting in relation to major planning proposals and a significant planning agreement offer to provide the infrastructure to support the proposed changes to the planning controls at Rhodes East.

Transport for NSW - Kings Hill and Menangle Park

Acting for Transport for NSW (formally the Minister for Planning and Public Spaces and RMS) on the AU$50M infrastructure arrangements to service the Kings Hill URA and AU$100M infrastructure arrangements to service the Menangle Park URA.

Aurizon

Acted for Aurizon on multiple land acquisition matters in Queensland and Victoria, including ongoing representation in relation to the Queensland Department of Transport and Main Road’s resumption for the Bruce Highway upgrade from Vantassel to Cluden.

Transport for NSW

Acting and advising Transport for NSW on hundreds of compulsory acquisition matters and Class 3 compensation proceedings associated with the acquisition of land and businesses for the M12, Westconnex, Metro related projects, South-West Rail Link, the Parramatta Light Rail Project, the Pacific Highway Upgrade and various other transitways and road widening projects.

Powerlink Queensland - Joyce acquisition

Resumption of easements for the purposes of a new dual voltage 275kv / 132kv transmission line between Ingham and Tully.

Redland City Council

Advising Redland City Council on a range of native title issues throughout the Redlands, being one of the earliest colonial settlement areas in Queensland. This includes conducting a detailed analysis of thousands of Council-controlled properties to determine possible extinguishment through historical public works and previous exclusive possession acts.

Peak Gold Mines - native title extinguishment analysis

Advised on native title analysis to support a mining lease application and representation in a native title determination application before the Federal Court.

Port of Townsville

Advised the Port of Townsville on native title issues associated with obtaining tenure and negotiated and concluded several cultural heritage plans and agreements with Indigenous parties for port projects.

Cultural heritage management plans and agreements

Prepared and negotiated cultural heritage management agreements and plans under Part 7 of the Aboriginal Cultural Heritage Act 2003 for Gold Coast City Council, Hinze Dam Alliance, QR, Stockland, Lend Lease, SunWater and others.

Queensland Alumina Limited - Cultural heritage

Advising on cultural heritage obligations and requirements associated with the operation of its alumina refinery at Gladstone.

Various clients - Heritage Register and Heritage Overlay Requirements

Advised clients such as Mirvac, Far East Consortium, Frasers, Stockland and Vodafone on the implications of heritage register listings and heritage overlays on development proposals and associated approval requirements.
